The Judicial Review Process
A judicial review claim must ordinarily be brought within three months of the challenged decision (or shorter in some immigration cases). The process begins with a pre-action protocol letter, which gives the Home Office an opportunity to reconsider its decision. If the matter is not resolved, a claim for permission to apply for judicial review is lodged with the Upper Tribunal or the Administrative Court. If permission is granted, the case proceeds to a full hearing.
