Immigration Appeals

First-tier and Upper Tribunal immigration appeals.

If your immigration application has been refused and you have a right of appeal, you can challenge the Home Office's decision before the First-tier Tribunal (Immigration and Asylum Chamber). A well-prepared appeal, presented by an experienced solicitor, can succeed even where the original application failed. BW Solicitors represents clients at immigration tribunals across London and beyond.

When Is There a Right of Appeal?

The right of appeal in immigration cases is more limited than it once was. Rights of appeal generally exist in asylum and human rights cases, in cases involving EU free movement rights, and in certain entry clearance cases involving family members. In some cases, administrative review is the only available remedy. Our solicitors will advise you on whether you have a right of appeal or whether another remedy — such as administrative review or judicial review — is more appropriate.

  • Asylum and protection claim refusals
  • Human rights claim refusals (Article 8 ECHR)
  • EU Settlement Scheme refusals
  • Entry clearance refusals in family reunion cases
  • Decisions to deport on conducive to the public good grounds
  • Certain decisions to curtail or cancel leave
