EU Settled Status
EUSS applications, late applications and upgrades to settled status.
The EU Settlement Scheme (EUSS) was the route by which EU, EEA and Swiss nationals and their family members could apply to secure their immigration status in the UK following Brexit. Although the main deadline for applications under the EUSS was 30 June 2021, late applications continue to be accepted where there are reasonable grounds for the delay. BW Solicitors assists EU nationals and their family members in Ilford and London with a range of EUSS-related matters.
Late Applications to the EU Settlement Scheme
If you are an EU, EEA or Swiss national, or a family member of such a person, and you did not apply to the EUSS before the 30 June 2021 deadline, you may still be able to apply if you can demonstrate reasonable grounds for your late application. Reasonable grounds may include serious illness, being a child, being in an abusive relationship, or simply not being aware of the requirement to apply. Our solicitors will assess your circumstances and advise you on the best approach.
- Assessment of whether you have reasonable grounds for a late application
- Preparation of a strong late application with supporting evidence
- Applications for children who were not included in a parent's earlier application
- Applications where a previous application was refused
Family Members of EU Nationals
Non-EEA family members of EU nationals who exercised free movement rights in the UK before 31 December 2020 were also eligible to apply to the EUSS. If you are the non-EEA spouse, civil partner, child or dependent relative of an EU national and did not apply in time, late applications remain possible. Our solicitors can advise on the specific requirements for each category of family member.
- Spouses and civil partners of EU nationals
- Unmarried partners in durable relationships
- Dependent children and grandchildren
- Dependent parents and grandparents
- Extended family members with facilitated rights
Upgrading from Pre-Settled to Settled Status
If you hold Pre-Settled Status and have now completed five years of continuous residence in the UK, you may be eligible to upgrade to full Settled Status. It is important to apply for this upgrade before your Pre-Settled Status expires. Our team will help ensure your application is made at the right time and with the right supporting evidence.
