Administrative Review

Challenging Home Office case-working errors.

An administrative review is the mechanism for challenging a visa refusal where you believe the Home Office caseworker made an error in law or in the application of the Immigration Rules. Unlike an appeal to the Tribunal, an administrative review is decided internally by the Home Office. BW Solicitors provides expert advice on administrative reviews across all visa categories.

When Is Administrative Review Available?

Administrative review is available for most in-country visa refusals and certain entry clearance refusals where there is no right of appeal. The application must be made within 14 days of receiving the refusal (if you are in the UK) or 28 days (if you are outside the UK). Missing the deadline will result in the review being rejected, so it is important to act quickly.

  • In-country refusals of leave to remain applications
  • Refusals under the Points Based System (Skilled Worker, Student, Graduate Route etc.)
  • Refusals under the EU Settlement Scheme
  • Entry clearance refusals where there is no right of appeal
  • Invalidity decisions on applications
  • Certain decisions to curtail leave

Grounds for Administrative Review

An administrative review can only succeed if the original decision contained a caseworking error — for example, a mistake in applying the Immigration Rules, a failure to take into account relevant evidence, or an error in calculating whether requirements are met. Our solicitors will carefully analyse your refusal notice and advise you on whether there is a viable basis for review.

  • Error in law or in the application of the Immigration Rules
  • Failure to take into account relevant evidence submitted with the application
  • Incorrect assessment of whether requirements are met
  • Failure to apply the correct policy or guidance
  • Procedural errors in the decision-making process
